The Emergency Planning and Community
Right-to-Know Act contains four major provisions:
- Planning for chemical
emergencies;
- Emergency notification
of chemical accidents and releases
- Reporting of hazardous
chemical inventories;
- Toxic chemical release
reporting.

As a facility, it is your obligation
to report hazardous chemicals to the MGCLERC in order to allow it to prepare
an appropriate emergency response plan for the community.
What if I add a hazardous chemical
to my inventory?
You must send a list of the chemical and/or accompanying
Material Safety Data Sheets (MSDS) within ninety (90) days of bringing
it on site. Report to the local fire department, State Emergency Response
Commission (SERC), and the MGCLERC. These addresses are:

How do we do the annual inventory
reporting?
The appropriate reporting forms are avaliable on
the State Emergency Response Commission web site.
For those who want to file electronically,
TIER2SUBMIT
software download and instructions are available from
the USEPA website.
- TIER2SUBMIT
Electronic Reporting Software. Be sure to download
the Ohio form, since each state has a unique version.
Reporting threshholds for
gasoline adn diesel fuel have changed for service stations. If you still
must report, use the industry booklet on the SERC website.
For Retail
Service Stations Only
The State of Ohio recently
exempted retail service stations from sending an inventory report to
SERC, local emergency planning committees such as MGCLERC, and local
fire departments if they have less than 75,000 gallons of gasoline or
100,000 gallons of diesel fuel. Those having more than these amounts,
or have 10,000 pounds or more of kerosene or propane on-site, must still
file an annual inventory report. Refer to the decision-tree to determine
whether you should file a report.

Farmers must also report any hazardous materials
to the MGCLERC. A different filing manual is used. Here is a link to

What do we have to do If we have
a new Extremely Hazardous Substance (EHS)?
You must send an inventory report and accompanying
Material Safety Data Sheets (MSDS) within sixty (60) days to the local
fire department, State Emergency Response Commission (SERC), and the
MGCLERC. To determine if your chemical is an EHS, refer to the USEPA's
Consolidated List of Lists
or the Ohio Facility Reporting Compliance Manual (see above for proper
